Overview

  • Initial Application: The process typically begins with the individual filing an initial application for Social Security Disability benefits with the Social Security Administration (SSA). This application includes detailed information about the applicant's medical condition, work history, and other relevant information.
  • Evaluation by SSA: The SSA reviews the application to determine if the individual meets the basic eligibility criteria for disability benefits. This includes assessing whether the applicant has a qualifying medical condition that meets the SSA's definition of disability and whether they have earned sufficient work credits to qualify for Social Security Disability Insurance (SSDI) benefits.
  • Medical Evaluation: The SSA may request additional medical records and information from the applicant's healthcare providers to assess the severity of the applicant's medical condition and its impact on their ability to work.
  • Decision on Initial Application: After reviewing all the relevant information, the SSA will make a decision on the initial disability claim. If the claim is approved, the applicant will begin receiving disability benefits. If the claim is denied, the applicant has the right to appeal the decision.
  • Appeals Process: If the initial application is denied, the applicant can request an appeal within a specified timeframe. The appeals process typically involves several stages, including reconsideration by the SSA, a hearing before an administrative law judge, and further appeals to the SSA's Appeals Council and federal court, if necessary.
  • Hearing before Administrative Law Judge (ALJ): If the applicant requests a hearing, they will have the opportunity to present their case before an ALJ. The ALJ will review the evidence, including medical records and testimony from the applicant and any witnesses, and make a decision based on the regulations and guidelines set forth by the SSA.
  • Decision on Appeal: After the hearing, the ALJ will issue a decision on the appeal. If the appeal is approved, the applicant will receive disability benefits. If the appeal is denied, the applicant may continue to pursue further appeals through the SSA's Appeals Council and federal court.
  • Continuing Disability Reviews (CDRs): Once approved for disability benefits, recipients may be subject to periodic reviews to assess whether they continue to meet the eligibility criteria for benefits. These reviews, known as Continuing Disability Reviews (CDRs), help ensure that benefits are being provided to those who still meet the SSA's definition of disability.
